The Attorney General of Kenya, however, answered-

that his original advice was based upon the opinion of

of his predecessors and, moreover, that the validity of a previous Ordinance/delegate the Governor's

power to the Commissioner of Lands had been called

in question by the local Law Society, who had

declined to accept titles signed by the

Commissioner with the result that the Ordinance had

been amended so as to require execution by the

Governor. Eventually the relevant article of the

East Africa Order in Council was amended by the

addition of the following provision "Nothing in this

Article shall be deemed to affect the power of the

Governor and Legislative Council to enact legislation

regarding the form, execution and conditions of such

grants and dispositions.

You will no doubt wish to reconsider the

three

matter in the light of the above information. I should

be reluctant to propose an amendment of the Letters

Patent in the present circumstances unless such a course

is really necessary.
